This article explores managers’ ethical reasoning for behaviors in price negotiations using evidence from 15 in-depth interviews conducted with sales and purchasing representatives in the chemical industry in Germany. Applying transaction cost economics, we find that negotiators in commoditized market-like exchanges either refer to deontological norms such as not to lie, or they neglect a role for ethics, arguing that distributive negotiation is per se opportunistic. In contrast, exchanges of products with higher asset specificity lead to stronger informational integration which (...) is supported with teleological justifications. Some negotiators use teleological justification to build business on trust rather than on economic safeguards as their firm norms would require. For negotiators, our results suggest considering institutional context and adjusting ethical reasoning to the negotiation situation. Firms need to recognize and find ways to address the potential conflicts of their internal norms with their frontline managers’ attempts to act in the firms’ best economic and ethical interests. Machine learning-driven clinical decision support systems (ML-CDSSs) seem impressively promising for future routine and emergency care. However, reflection on their clinical implementation reveals a wide array of ethical challenges. The preferences, concerns and expectations of professional stakeholders remain largely unexplored. Empirical research, however, may help to clarify the conceptual debate and its aspects in terms of their relevance for clinical practice. This study explores, from an ethical point of view, future healthcare professionals’ attitudes to potential changes of responsibility and decision-making (...) authority when using ML-CDSS. Twenty-seven semistructured interviews were conducted with German medical students and nursing trainees. The data were analysed based on qualitative content analysis according to Kuckartz. Interviewees’ reflections are presented under three themes the interviewees describe as closely related: (self-)attribution of responsibility, decision-making authority and need of (professional) experience. The results illustrate the conceptual interconnectedness of professional responsibility and its structural and epistemic preconditions to be able to fulfil clinicians’ responsibility in a meaningful manner. The study also sheds light on the four relata of responsibility understood as a relational concept. The article closes with concrete suggestions for the ethically sound clinical implementation of ML-CDSS. (shrink)

Jahrhundert immer weiter nach Europa vordrangen und die Christenheit eine militärische Niederlage nach der anderen kassierte, entwickelte seit dem Basler Konzil (1431-1449) eine Gruppe führender Philosophen, Humanisten und Theologen eine Alternative zu Krieg und Kreuzzügen: die friedliche Bekehrung der Muslime. Ein Netzwerk um Nikolaus von Kues, Heymericus de Campo, Johannes von Segovia, Enea Silvio Piccolomini und Georg von Trapezunt erarbeiteten mit- und gegeneinander höchst originelle philosophische und rhetorische Argumentationen. Beispielsweise erdachten sie Pläne für eine Friedenskonferenz (...) mit den Muslimen und versuchten, den Koran selbst gegen den Islam ins Feld zu führen, womit sie übrigens die Basis für die Islamstudien der Neuzeit legten. Emergency situations require individuals to make important changes in their behavior. In the case of the COVID-19 pandemic, official recommendations to avoid the spread of the virus include costly behaviors such as self-quarantining or drastically diminishing social contacts. Compliance (or lack thereof) with these recommendations is a controversial and divisive topic, and lay hypotheses abound regarding what underlies this divide. This paper investigates which cognitive, moral, and emotional traits separate people who comply with official recommendations from those who don't. In (...) four studies (three pre-registered) on both U.S. and French samples, we found that individuals' self-reported compliance with official recommendations during the COVID-19 pandemic was partly driven by individual differences in moral values, disgust sensitivity, and psychological reactance. We discuss the limitations of our studies and suggest possible applications in the context of health communication. (shrink)

During the last years, there has been an increasing discussion on the role of business in human rights violations and an increase in human rights litigation against companies. The result of human rights litigation has been rather disillusioning because no corporation has been found guilty and most cases have been dismissed. We argue that it may nevertheless be a useful instrument for the advancement of the business and human rights agenda. We examine the determinants of successful human rights litigation in (...) terms of judicial, educational, and regulatory effects. This article reviews more than 40 corporate foreign direct liability cases and their effects on corporate human rights policies and conduct. The review shows that most corporations adjusted their human rights policies and adopted additional measures to cope with human rights issues during or shortly after the legal proceedings. Opening legal channels for human rights litigation may be one way for governments to incentivize firms to respect human rights. These findings have implications for the United Nations Guiding Principles on Business and Human Rights as well as on our interpretation of the most recent U.S. Supreme Court decision in Kiobel v. Georg Simmels philosophisches Werk steht quer zu etablierten Fachgrenzen. Das gilt auch für die "Philosophie des Geldes", in dem sein Interesse an unterschiedlichen Phänomenen des Sozial- und Kulturlebens – Freiheit, Weltanschauung, Gesellschaft, Politik, Religion, Kunst u.v.m – sich bereits abzeichnet, bevor es in den folgenden Jahren in Schriften zur Soziologie, Psychologie, Ästhetik, Kulturtheorie entfaltet wird. Schon der Titel einer "Philosophie des Geldes" ist ein Novum. Hier wird nämlich ein Bereich des sozialen Lebens, das wirtschaftliche Leben, zum Gegenstand der Analyse gemacht, (...) um nicht die Einheit des kulturellen Lebens, sondern um dessen geistige Grundlagen zu untersuchen. In der Selbstanzeige des Buches für den Verlag Duncker & Humblot schreibt Simmel, dass er mehrere Zielsetzungen verfolgt. Zum einen will er die Einseitigkeiten von Idealismus und Materialismus korrigieren und Geschichte respektive Kultur als ein Wechselspiel zwischen materiellen und ideellen Faktoren begreifen. Zum anderen will er den Beweis führen, dass sich von jedem Punkte der gleichgültigsten, unidealsten Oberfläche des Lebens ein Senkbeil in seine letzten Tiefen des menschlichen lebens werfen lässt. Damit ist gemeint, dass jedes Lebensphänomen als ein Aspekt und ein Träger einer Einheit von Sinn angesehen werden kann. Die These ist, dass sich menschliches Leben als Sinngeschehen vollzieht, was sich in allen Lebensvollzügen – vom ästhetischen über das wirtschaftliche bis zum religiösen Handeln – überprüfbar sein muss. Die "Philosophie des Geldes" besteht aus zwei Teilen, einem analytischen und einem synthetischen Teil. Im analytischen Teil wird die systematische und historische Explikation einer allgemeinen Kulturtendenz dargestellt. Es geht um den Befund eines Nebeneinanders zweier Welten, dort die Natur und hier die Welt der Werte, die sich aufeinander beziehen und doch voneinander getrennt entwickeln. Auf die Welt der Werte bezogen, also unsere menschliche Welt, die wir im Denken und Handeln erzeugen und die wir sinnverstehend erschließen können spricht Simmel von einer Entwicklungstendenz, einem Übergang von Substanz- zu Funktionsvorstellungen – vom einem sich verändernden Gebrauch der Kategorien, beispielsweise Mittel/Zweck. Im synthetischen Teil geht Simmel auf die Probleme der menschlichen Lebensführung ein, wozu das Problem von Freiheit und Verpflichtung und auch die Frage gehört, wie wir unserem Leben eine Form geben können, Im instruktiven, das Werk abschließenden Kapitel über den Stil des Lebens mündet die Diagnose der modernen Kultur in die Überlegung, was es für uns heißen könnte, unter den bedingungen eines relativistischen Weltbildes dem eigenen Leben eine Form und Richtung zu geben. Die "Philosophie des Geldes" ist ein großes Werk der Philosophie, in dem es, diesseits der üblichen Trennung in theoretische und praktische Fragen der Philosophie, noch einmal um die letzten Probleme der Philosophie geht. Since 1989, clinical ethics consultation in form of hospital ethics committees was established in most of the transition countries of Central and Eastern Europe. Up to now, the similarities and differences between HECs in Central and Eastern Europe and their counterparts in the U.S. and Western Europe have not been determined. Through search in literature databases, we have identified studies that document the implementation of clinical ethics consultation in Central and Eastern Europe. These studies have been analyzed under the following (...) aspects: mode of establishment of HECs, character of consultation they provide, and their composition. The results show that HECs in the transition countries of Central and Eastern Europe differ from their western-European or U.S. counterparts with regard to these three aspects. HECs were established because of centrally imposed legal regulations. Little initiatives in this area were taken by medical professionals interested in resolving emerging ethical issues. HECs in the transition countries concentrate mostly on review of research protocols or resolution of administrative conflicts in healthcare institutions. Moreover, integration of non-professional third parties in the workings of HECs is often neglected. We argue that these differences can be attributed to the historical background and the role of medicine in these countries under the communist regime. Political and organizational structures of healthcare as well as education of healthcare staff during this period influenced current functioning of clinical ethics consultation in the transition countries. In light of the increasing refusal of some parents to vaccinate children, public health strategies have focused on increasing knowledge and awareness based on a “knowledge-deficit” approach. However, decisions about vaccination are based on more than mere knowledge of risks, costs, and benefits. Individual decision making about vaccinating involves many other factors including those related to emotion, culture, religion, and socio-political context. In this paper, we use a nationally representative internet survey in the U.S. to investigate socio-political characteristics to assess (...) attitudes about vaccination. In particular, we consider how political ideology and trust affect opinions about vaccinations for flu, pertussis, and measles. Our findings demonstrate that ideology has a direct effect on vaccine attitudes. In particular, conservative respondents are less likely to express pro-vaccination beliefs than other individuals. Furthermore, ideology also has an indirect effect on immunization propensity. The ideology variable predicts an indicator capturing trust in government medical experts, which in turn helps to explain individual-level variation with regards to attitudes about vaccine choice. Context: Epistemologically, constructivism has reached its goals, particularly by emphasizing the idea of participatory observation, circularity, and the fact that construction is based on experience. However, rather than research, the main occupation of constructivists and second-order cyberneticians seems to lie in making the case for their epistemological idea, which has been exhausted in many aspects. Purpose: To counteract this exhaustion and an increasingly apparent lack of energy, it is argued that constructivism requires a dedicated field of research, a field where (...) it would be possible to test constructivist concepts empirically and thus go beyond mere theoretical discourse. Method: Based on a review of basic constructivist premises and a critical examination of the field of empirical phenomenological research, the article connects their respective findings. Results: The article proposes that empirical research on lived experience requires a constructivist epistemological foundation and might therefore be a logical continuation of constructivist endeavours. In such a way, both fields might benefit considerably. Not only would constructivism acquire an empirical tool for testing its ideas, such a partnership might also provide empirical phenomenology with a more suitable epistemological platform than the realism-based research framework of cognitive science (of which it has become an integral part. The possibilities and problems of introducing empirical research into constructivism are also discussed. Implications: The article presents an opportunity to re-think the role and future of constructivism. It suggests educating a new generation of constructivist researchers whose principal goal would be the attempt to study lived human experience. That could also open a path to the experimental grounding of many constructivist insights. (shrink)

According to interpretivism, all there is to having an intentional property is being best interpreted as having it. I present a regress-or-circularity argument against this. In §1, I elucidate interpretivism, and in §2, I present the argument against it.

This paper puts forward an ontology that is indebted to QBism, Kant, Bohr, Schrödinger, the philosophy of the Upanishads, and the evolutionary philosophy of Sri Aurobindo. Central to it is that reality is relative to consciousness or experience. Instead of a single mind-independent reality, there are different poises of consciousness, including a consciousness to which “we are all really only various aspects of the One”. This ontology helps clear up unresolved issues in the philosophy of science, such as arise from (...) the reification of quantum states or from disregard of the universal context of science, which is human experience. It further helps clear up unresolved issues in the philosophy of mind, in particular the problem of intentionality and the dilemma posed by the mutual inclusion of self and world. (shrink)

The set-theoretic and individual-theoretic analyses of collections make the same mistake: their ontologies are far removed from language. Our basic notion, the collector, has a clear linguistic counterpart: the definite article. Our theory furnishes a theory of definite descriptions as a special case. We use 3-valued valued logic in order to come to grips with the existential presuppositions of the collections.

Avery’s et al. ’s 1944 paper provides the first direct evidence of DNA having gene-like properties and marks the beginning of a new phase in early molecular genetics (with a strong focus on chemistry and DNA). The study of its reception shows that on the whole, Avery’s results were immediately appreciated and motivated new research on transformation, the chemical nature of DNA’s biological specificity and bacteria genetics. It shows, too, that initial problems of transferring transformation to other systems and prominent (...) criticism of its results nurtured skepticism. Avery’s experiment was downplayed and neglected particularly by many of those scientists who worked in the new fields of biochemical and biophysical genetics, genetic phage, and TMV research. This was not due to the fact that the implications of the paper could not be connected to generally accepted knowledge. Contrary to a widespread belief, the assumed uniformity of DNA as opposed to proteins was not used as an argument against the validity of Avery’s et al.’s finding. The indifference rather reflected, among other things, the disciplinary gap between the chemically oriented microbiologists and the old and new geneticists who remained committed to genetic and physical methods (in particular x-ray studies) and clung to the assumption that proteins were the sole carriers of biological specificity. The responses to Avery’s et al.’s paper show how different research interests in the areas between microbiology, genetics, and biochemistry interacted with the prejudices, dogmas, individual farsightedness or short-sightedness, and scientific authority during a pivotal period of early molecular biology.
